New Jersey Sexual Assault Law
We represent clients charged with N.J.S.A. 2C:14-2(c); New Jersey Sexual Assault indictments filed in Middlesex County, Monmouth County, Mercer County, Somerset County, Essex County, Union County, and Hudson County.
This type of an Assault is a crime of the second degree.
There is no statute of limitations for this type of an assault.
There are two types of assault.
The first type does not require proof of penetration.
For this offense that does not require proof of penetration there are four material elements.
First, a victim less than thirteen years old.
Second, a defendant who is at least four years older than the victim.
Third, a sexual contact with the victim.
Fourth, this contact was intentional or purposeful touching.
The other types of assault do require proof of penetration
Any act of sexual penetration engaged in by the defendant without the affirmative and freely given permission of the victim to the specific act of penetration constitutes the offense of an assault.
Consent is not a defense to any assault in which one of the elements is that the victim is less than a specified age, mentally defective or incapacitated or the defendant had a supervisory or disciplinary status over the victim.
