New Jersey Terroristic Threats

This is a crime of the third degree.
This offense is limited to threats to commit a crime of violence.
The conduct must be purposeful and reckless.
The threats may be oral or written.
It must be more than a threat which causes alarm.
Such threats must present a serious alarm for safety.
These would include threats to injure, maim or to burn, destroy or injure property.
It would also include a threat to kidnap a child.
The state must prove three material elements for this offense.
The first element is the threat.
The second element is that the threat must be to commit a crime of violence.
The third element is that the threat was made with a purpose to either terrorize another or to cause the evacuation of a building, facility of public transportation or other place of assembly or otherwise to cause serious public inconvenience.
In the alternative to proving purpose, the state may prove that defendant acted recklessly by disregarding the risk of causing terror or inconvenience.
